In this Policy a reference to 'Meetseeker' or 'we' or 'us' means MeetSeeker Group Pty Ltd.

In this Policy a reference to 'the Site' means the website www.meetseeker.com.au

At Meetseeker, we believe that an individual's right to keep their personal information private is very important. We are committed to protecting your right of privacy and ensuring the accuracy and security of all of your personal information is in accordance with the Privacy Act 1988 (Cth) and the National Privacy Principles set out therein.

This Privacy Policy outlines how we manage your personal information, including how it is:

- Disclosed.

3. What is Personal Information?

Personal Information includes a person's or organisation's name, contact details, date of birth, gender, relationships, and identifiers assigned by the Government such as an Australian Business Number (ABN) or Australian Company Number (ACN) and any other information or opinion about a person whose identity is apparent or can be ascertained from that information or opinion.

The Privacy Act deems some personal information to be sensitive personal information. Such sensitive information includes your medical history, religious views, ethnicity, sexual orientation, criminal record and political opinions.

Generally, we will not need to collect such sensitive information, however it may be necessary in some situations and your consent will be obtained.

4. Why we collect your personal information

Meetseeker needs to obtain your personal information so that we can provide, manage and administer the products and services that you seek efficiently and effectively.

It is our usual practice to collect personal information directly from the individual.

Sometimes we collect personal information from a third party such as an Employment Service Provider, but only if the individual has consented to collection or would reasonably expect us to collect their personal information, or if it is necessary for a specific purpose.

You may refuse to provide us with your personal information at any time. We may, however, be unable to provide you with certain products or services without particular personal details.

Some of your personal information will appear on the Site if we upload your individual profile. We will not disclose your contact details to any third party unless you consent. If you are an Employer utilising the Site, we will collect your personal information including your ABN or ACN and contact details. If you select an individual's profile, your personal information will be forwarded to that individual and their Employment Service Provider, if applicable, and only for the purposes of arranging a face to face meeting.

5. How we collect your personal information

Where it is reasonable and practical to do so, we will only collect personal information about you directly, such as on application forms or over the phone or Internet.

Where it is necessary to obtain personal information about you from other sources, for example from your Employment Service Provider, we will seek your consent (and tell you from whom or where we are collecting information and why).

We will only collect your personal information by lawful means, for the sole purpose of securing employment.

6. How we use your personal information

We will only use your personal information for the purpose for which it was collected – for example to upload your profile onto the Site for potential Employers to view or to provide Employer's contact details to individuals selected by Employers. We may also disclose non-identifiable statistical information to third parties, such as Government Departments, e.g. Department of Education, Employment and Workplace Relations (DEEWR). With your consent, we may disclose information collected to third parties for the purpose of training, education, employment, participations and engagements from all stakeholders and subscribers.

7. To whom we disclose your personal information

We will not provide an individual's contact details or personal information to a prospective Employer without the individual's consent. If a prospective Employer requests us to do so, we will provide the prospective Employer's details to an individual and, if necessary, to an Employment Service Provider.

8. Your information will be secure

We are committed to keeping all data supplied by you to us secure and confidential.

Only employees of Meetseeker and Employment Service Providers who are authorised to handle your information will have access to your personal information. Personal information will only be disclosed at the individual's request or with consent.

We have document handling and information technology procedures in place to ensure that your information is protected from misuse, loss and unauthorised/illegal access or use.

We will not retain any of your information for any longer than it is required by us, except to comply with legal obligations imposed upon us.

9. You can access your information

In most cases, you can access the personal information we hold about you.

You can do this online using your password and login name or via your Employment Service Provider.

Your online profile will remain on the Site until you find employment or make a written request to us to remove it.

We may not always be able to give you access to all the personal information we hold about you. We may not be able to give you access to information that:

- Would reveal personal information about others.

- Would reveal sensitive commercial Meetseeker information.

- We are prevented or entitled by law to disclose or retain.

Meetseeker is committed to ensuring the accuracy of your personal information. We will, with your assistance, keep your personal information accurate, complete and up to date.

Definitions

'the Site' means www.meetseeker.com.au

'Supported Seekers' means users of www.meetseeker.com.au who are in receipt of Government benefits.

'Private Seekers' means users of www.meetseeker.com.au who are not in receipt of Government benefits.

'Seekers' means users of www.meetseeker.com.au who are either supported Seekers or Private Seekers (as defined above).

'Employment Service Provider' means any employment agency which is part of the Federal Government's Job Services Australia network.

'Employers' means individuals, companies, organisations who register with Meetseeker with a view to employing an individual profiled on www.meetseeker.com.au

'Meetseeker' or 'us' means MeetSeeker Group Pty Ltd.

1. Please read this agreement carefully before accessing or using the information and services available through the Site. By accessing or using the Site, you agree to be bound by the terms and conditions below. We may modify this agreement at any time and such modifications shall be effective immediately upon posting the modified agreement on the Site.

2. The Site is owned, managed and maintained by Meetseeker.

3. Meetseeker has the right to:

- Decide what information, including links to other websites, is displayed on the Site.

- Remove any information or Seeker that does not meet the Terms and Conditions; does not comply with relevant laws; is in breach of a contract entered into between you and Meetseeker or that Meetseeker in its sole discretion considers to be an unacceptable or inappropriate use of the Site.

- Gather and use feedback from users of the Site to help improve and develop the Site.

- Where you do not comply with these Terms and Conditions, refuse future access to the Site as we see fit.

4. You agree not to use our services or the Site to:

- Harvest or collect email addresses or other contact information of other users from the Site by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications.

- Use the Site in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Site.

- Upload, post, transmit, share, store or otherwise make available any content that we deem to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable.

- As a Seeker or Employer, register for more than one user account, register for a user account on behalf of an individual other than yourself, or register for a user account on behalf of any group or entity to which you do not properly belong.

- Impersonate any person or entity, or falsely state or otherwise misrepresent yourself, your age or your affiliation with any person or entity.

- Intimidate or harass another.

- Upload, post, transmit, share, store or otherwise make available content that would constitute, encourage or provide instructions for a criminal offence, violate the rights of any party, or that would otherwise create liability or violate any state, federal or international law.

5. By placing information on the Site, we are not providing professional advice.

6. We do not guarantee the accuracy or reliability of the material placed on the Site.

7. Material on the Site may include the views or recommendations of others that are not necessarily our views.

8. You should make your own enquiries to check if material on the Site is accurate and reliable.

9. Links to other websites are provided for your convenience only. We do not endorse material on linked websites or their organisation, its products or services.

10. You agree to indemnify and hold us, our subsidiaries and affiliates, and each of their directors, officers, agents, contractors, partners and employees, harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable legal fees, arising out of or in connection with any user content, any Third Party applications, software or content you post or share on or through the Site, your use of the Site, your conduct in connection with the our services or the Site or with other users of our service or the Site or any violation of this agreement or any law or rights of any third party.

11. In no event will we be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including for any lost profits or lost data arising from your use of the Site, any platform applications or any of the Site content or other materials on, accessed through or downloaded from the Site, even if we are aware or have been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us for our service. You acknowledge that if no fees are paid to us for our service, you shall be limited to injunctive relief only, unless otherwise permitted by law, and shall not be entitled to damages of any kind from us, regardless of the cause of action.

12. You agree that information contained on this Site is for personal use only and may not be sold, redistributed or used for any commercial purpose (this includes but is not limited to the use of Advertiser contact details for unsolicited commercial correspondence). You may download material from this Site for your personal, non-commercial use only, provided you keep intact all copyright and other proprietary notices.

13. You may not modify copy, reproduce, republish, upload, post transmit or distribute in any way any material from this Site including code and software. You must not use this Site for any purpose that is unlawful or prohibited by these terms of use.

14. You may not use data mining, robots, screen scraping or similar data gathering and extraction tools on this Site for establishing, maintaining, advancing or reproducing information contained on our Site on your own website or in any other publication except with our prior written consent.

15. Meetseeker does not endorse or recommend any of the Seekers advertised on its Site and Meetseeker strongly recommends that prior to entering into any agreement with any of the Seekers on the Site, that you obtain your own independent legal, accounting or financial advice and make any other relevant enquiries, as appropriate. It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, services, merchandise and other information provided through the Site or on the Internet generally.

16. In no event will Meetseeker be liable to you or anyone else for any decision made or action taken by you or anyone else in reliance upon any information contained on or omitted from the Site.

17. Meetseeker does not guarantee to you the continued availability of any Seeker advertised on the Site and will not be liable to you should a Seeker have obtained employment at any time prior to removal of the Seeker's profile from the Site.

18. Whilst Meetseeker takes efforts to ensure that Employers using the Site are seeking to fill an actual job vacancy, it gives no guarantee to you that every Employer represents an actual job vacancy.

19. Meetseeker provides no warranty to you that the services generally available through its Site will be uninterrupted or error-free or that defects in the service will be corrected. You also understand that Meetseeker cannot and does not guarantee or warrant to you that files available for downloading through the Site or delivered via electronic mail through the Site will be free of infection or viruses, worms, Trojan horses or other codes that manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data.

20. Meetseeker welcomes ideas and feedback from you about all aspects of the Site. You agree that Meetseeker may reproduce, distribute, transmit, create derivative works of, and publicly display any materials and other information (including ideas for new or improved products and services) that you submit to any public areas of the Site. (Please read our Privacy Policy for more information as to how we deal with information you send to us.)

21. While Meetseeker takes all due care in ensuring the privacy and integrity of the information you provide, the possibility exists that this information could be unlawfully observed by a third party while in transit over the Internet or while stored in Meetseeker systems or on Meetseeker's Site. Meetseeker disclaims all liability to you to the greatest extent possible pursuant to the law should this occur.

22. To become a registered user, you must provide a password and a login name. You are entirely responsible if you do not maintain the confidentiality of your password and login name. Furthermore, you are entirely responsible for any and all activities that occur under your login name. You may change you password at any time by following instructions. You may also change your login name by contacting us.

23. You agree to immediately notify Meetseeker of any unauthorised use of your login name or any other breach of security known to you.

24. You agree that it is a condition on your use of the Site that you will not, either through any act or omission, mislead or deceive others.

25. The Site may be temporarily unavailable from time to time for maintenance or other reasons. We assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, user communications. We are not responsible for any technical malfunction or other problems of any telephone network or service, computer systems, servers or providers, computer or mobile phone equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any Site or combination thereof, including injury or damage to user's or to any other person's computer, mobile phone, or other hardware of software related to or resulting from using or downloading materials in connection with the Internet and/or in connection with the Site. Under no circumstances will we be responsible for any loss or damage, including any loss or damage to any user content, or personal injury or death, resulting from anyone's use of the Site or the Service, any user content or Third Party applications, software or content posted on or through the Site or transmitted to users, or any interactions between users of the Site, whether online or offline.

26. We may delete your profile and any content or information you have posted on the Site and/or prohibit you from using or accessing the Site (or any portion, aspect or feature of the Site or any Platform Application) for any reason, or no reason, at any time in our sole discretion, with or without notice.

27. Seekers agree to provide us with personal contact details including a mobile phone number and email address.

28. Seekers consent to receiving an alert by SMS and email when an Employer confirms with us that they wish to approach a Seeker for an interview.

29. Seekers consent to us uploading your profile onto the Site.

30. Seekers consent to us disclosing personal information to an Employer.

31. Seekers consent to us disclosing non-identifiable statistical information to third parties. Information collected may be disclosed to third parties for the purpose of training, education, employment, participations and engagements from all stakeholders and subscribers.

32. An online profile will remain on the Site until Seekers obtain employment or a written request is made to us by you or your Employment Service Provider for the removal of your profile.

33. It is the responsibility of the Seeker to ensure that an Employer is legitimate. While Meetseeker takes all reasonable steps to ensure that all Employers are legitimate entities, Meetseeker takes no responsibility for persons representing themselves as Employers utilising the Meetseeker website.

34. Meetseeker may produce a video profile of the Seeker to be uploaded by us on the Site, upon request made to us and upon payment of any production fee as determined by us.

35. If any part of this agreement is held invalid that part shall be severed from this agreement and the remainder of this agreement will continue to be valid and enforceable.

36. Termination of this agreement will not end those provisions that are capable of surviving the end of this agreement.

37. The laws governing this agreement will be the laws in New South Wales, Australia and you irrevocably submit to the exclusive jurisdiction of its Courts and its Appellate Courts and the jurisdiction of the Federal Court of Australia sitting in New South Wales.

Specific Conditions of Use for Supported Seekers

38. Supported Seekers consent to your Employment Service Provider disclosing your personal information to us.

39. Supported Seekers consent to us disclosing to your Employment Service Provider details of SMS and email alerts sent to Supported Seekers.

40. Supported Seekers may update your profile via your Employment Service Provider and Supported Seekers consent to your Employment Service Provider doing so as requested by Supported Seekers.

Specific Conditions of Use for Employment Service Providers

41. The Employment Service Provider agrees to update a Supported Seeker's online profile upon request by the Supported Seeker.

42. The Employment Service Provider agrees to receive alerts from us when a Supported Seeker is selected by an Employer.

43. The Employment Service Provider may request removal of a Supported Seeker's profile from the Site on behalf of the Supported Seeker.

Specific Conditions of Use for Private Seekers

44. Private Seekers agree to pay Meetseeker a fee nominated by us to upload a profile onto the Site.

45. The Private Seeker is not required to pay the fee in clause 44 above if the Private Seeker's profile is to be uploaded as part of the 'Seeker Showcase' on the Site.

Specific Conditions of Use for Employers

46. The Employer agrees to provide certain personal information to us, including a valid Australian Business Number (ABN) or an Australian Company Number (ACN).

47. The Employer consents to us disclosing personal information of the Employer to any Seeker selected by the Employer.

48. If the Employer selects a Supported Seeker, the Employer consents to us disclosing personal information of the Employer to a Supported Seeker's Employment Service Provider.

49. Employers consent to us disclosing non-identifiable statistical information to third parties. Information collected may be disclosed to third parties for the purpose of training, education, employment, participations and engagements from all stakeholders and subscribers.
